3.1   Legalisation

   
 

a. For documents that issued by Thai authority:

   
        Every document must be first legalized by the Department of Consular Affairs, Ministry of Foreign            Affairs of Thailand;
        A request letter from the company stating what document(s) that is going to be legalized by the            Embassy and the purpose of legalization;
        A set of copy of the document that need to be legalized;
        Submission time at the Embassy: 09.00 - 11.45;
   
  b. For Certificates issued by Indonesian authorities, such as Birth Certificate, Marriage     Certificates, Diploma, and so forth:
   
        Bring along the original and one copy of the document to the Embassy;
        Submission time: 09.00 - 11.45;
   

   
  3.2 Working in Indonesia
   
 

A General Information

   
  Please be informed that foreigners wishing to work and stay in Indonesia are advised to carefully read the following requirements and regulations:
   
  1. Any foreigners intending to work in Indonesia must have a sponsor both in Thailand and in Indonesia. A    sponsoring company/institution in the Indonesia, however large or small, is a necessary requirement.
   
  2. Applicants must be absolutely sure that the sponsoring company/institution in Indonesia can help them    with their application and provide them with the necessary assistance regarding the visa and work permit.    The sponsoring company/institution should approach the Immigration Office in Indonesia and be in    constant contact with the Immigration Office in Indonesia, not only for visa matters but also for other    matters involving the Immigration Office during and in connection with the applicants stay in Indonesia.
   
  3. Regarding stay permits, foreigners can only be issued with a VITAS (Visa Ijin Tinggal Terbatas) or also    known as a Limited/Temporary Admmission Visa for a maximum period of 12 (twelve) months, with the    possibility of extension (subject to approval from the Immigration authorities in Indonesia). Furthermore,    this temporary resident visa can only be obtained if the individual concerned has a sponsor/counterpart    in Indonesia who can help him/her obtain the visa by applying to the Immigration Office in Indonesia.    Please be advised that it takes a considerable length of time for an application to be processed.
   
  4. The length of stay in Indonesia for a VITAS is decided by the Immigration Office in Indonesia based on    the sponsor/counterpart's request.
   
  5. If and when the application is approved and the visa is then granted by the Immigration Office in    Indonesia, the Immigration Office will first notify the sponsor/counterpart in Indonesia and will give special    authorization to the Embassy to issue the visa. The necessary visa will be issued by the Embassy only    after special authorization has been received by the Embassy directly from the Immigration Office in    Indonesia.
   
  6. Please be advised that the notification of approval sent by the Immigration Office in Indonesia to the    applicant's sponsor in Thailand cannot be accepted or used by the Embassy to issue the visa as the    information contained therein is intended only for the applicant's information and does not in itself    authorize the Embassy to issue the visa.
   
  7. It is the responsibility of the company for which the applicant is working to contact the Embassy for the    result of the applicant's application to the Immigration Office in Indonesia for a permit to work in    Indonesia, and should their employee's application be granted, arrange with the Embassy when the    employee should come to the Embassy to complete the final application forms.
   
  8. The following documents should be submitted with the final application for a visa to work and stay in    Indonesia once approval has been granted by the Immigration Office in Indonesia:
   
       a. Completed visa application forms (must be originals, photocopies are not accepted)
       b. A valid passport with a minimum validity of 18 months as from the date of entry (for those who want to         stay and work in Indonesia)
       c. Two colour passport size photos
       d Written approval from the Immigration Office in Indonesia
       e. A complete and updated Curriculum Vitae (CV)
       f. Two letters of recommendation, one from the applicant's firm/office in THAILAND and the other from         the applicant's sponsor/counterpart in Indonesia setting out the reason for the visit, details of the         duration of the proposed visit, and responsibility for accommodation/maintenance costs;
       g. Evidence that the applicant has sufficient funds to maintain him/herself during his/her stay in         Indonesia (e.g. recent bank statements) or/and a third-party letter guaranteeing to support the         applicant financially during his/her stay in Indonesia, together with documentary evidence of the ability         to do so
       h. Visa application fee depends on the type of visa applied for and length of stay granted by the         Immigration Office in Indonesia.
   
  9. Application fees
   
       a. Application fees are non-refundable under all circumstances.
       b. All fees must be paid in Cash or Postal Orders only. Cheques are not acceptable at all times. Postal         Orders should be made payable to "the Embassy of the Republic of Indonesia".
       c. Applications sent by post should be by Registered Mail or Recorded Delivery accompanied by the         relevant fees (Postal Orders only, payable to the "Embassy of the Republic of Indonesia") and a
        pre-paid Registered Mail envelope must be enclosed if applicants wish their passport to be returned by         post.
       d. The Embassy of the Republic of Indonesia cannot be held responsible for the non-delivery of any         passports or other documents, or for damage in delivery.
   

   
  3.3 To get married in Indonesia
   
  Please note that the following information about the requirements of and procedures for getting married in Indonesia and that you should always consult your Embassy or Consulate General in Indonesia as well as the marriage authorities in Indonesia for more detailed information before you make any further plans.
   
  1. Valid passports (each passport being valid for a minimum 6 months as from the date of entry into     Indonesia).
   
  2. Valid visas to enter Indonesia.
   
  3. Birth Certificates (if a copy, and not the original, then the copy must be legalized by a solicitor or by the     individual's Embassy/ Consulate General in Indonesia).
   
  4. Minimum age to get married : females must be aged 16 years or over, and males must be aged 19 years     or over.
   
  5. Letter from both sets of parents/guardians, stating that there are no objections to the marriage.
   
  6. Legalised written statements confirming the status of each individual (single/ widow/ widower/ divorcee     etc.).
   
  7. Letter from the couple's Church (if the couple are both Christians and members of a church and wish to     be married in a church in Indonesia).
   
  8. If one or both persons wishes to convert to Islam and be married according to Islamic Law, the marriage     must be reported and registered with the Religious Affairs Office (Kantor Urusan Agama) in Indonesia. If     the marriage is to be a Christian one, the marriage must be reported and registered with the Civil     Registration Office (Kantor Catatan Sipil) in Indonesia.
   
  9. The Offices in Indonesia authorized to perform such marriages:
   
       The Religious Affairs Office (Kantor Urusan Agama) and the Mosque for Moslems;
       The Civil Registration Office (Kantor Catatan Sipil) and the Church for Christians.
   
  10. Please be advised that each region in Indonesia has different customs/ traditions when conducting       wedding ceremonies.
   
  11. To ensure that your marriage in Indonesia is valid and legal in Thailand, you should registere your      marriage to your local registration office. In this regards, may we suggest that you have all      documentation translated by a sworn and authorised Thai translator in Indonesia before you return to      the Thailand.
   

   
 

3.4 Status Conversion of Immigration Permits

   
  A status conversion of an Immigration Permit is the changing of status of a Visit Permit into a Limited Stay Permit, or a Limited Stay Permit into a Permanent Stay Permit.
   
  A. Visit Permits Into Limited Stay Permits
   
  1. Conversion Provisions :
   
       a. The following Visit Permits are convertible into Limited Stay Permits
           1. A Visit Permit for the purpose of doing business;
           2. A Visit Permit for socio-cultural purposes;
           3. A Visit Permit in the framework of government duties.
   
       b. The following Visit Permits are not convertible into Limited Stay Permits
           1. A Visit Permit for the purpose of tourism;
           2. A Visit Permit on Arrival;
           3. A Visit Permit for Free Short Visit Visas.
   
       c. A conversion shall be allowed for a foreign national in the framework of
           1. investment;
           2. employment as an expatriate expert;
           3. employment for social activities;
           4. carrying out scientific research;
           5. carrying out religious duties;
           6. for education and training;
           7. joining a husband in possession of a Limited Stay Permit/Permanent Stay Permit or who is an              Indonesian citizen;
           8. joining a parent, for single, under-aged, legitimate child(ren) of a parent in possession of a Limited              Stay Permit/Permanent Stay Permit or who is an Indonesian citizen;
           9. repatriation for a former Indonesian citizen in the framework of regaining Indonesian citizenship;
           10. national development or other reasons related to humanitarian considerations.
   
       d. The foreign national concerned must have been residing in Indonesia for at least 4 (four) months          consecutively from the date of admission.
   
       e. The issuance of a Visit Permit status conversion into a Limited Stay Permit shall be determined by          decision of the Director General of Immigration.
   
       f. The issuance of a status conversion shall be executed by the Head of the Local Immigration Office         upon approval of the Director General of Immigration through the Head of the Regional Office or a         designated official.
   
 

2. Requirements:

   
  An application for the status conversion of a Visit Permit into a Limited Stay Permit shall be submitted in triplicate to the Director General of Immigration, or a designated official, through the Head of the Local Immigration Office whose jurisdiction covers the area of residence of the applicant, with the following enclosures :
   
       a. An application letter from the foreign national concerned and his/her sponsor which
         contain-information concerning the reason for the status conversion and a guarantee for said foreign          national from the sponsor during his/her stay in Indonesia until his/her exit from Indonesia;
   
       b. Original and photocopies of a valid passport or travel document which includes information about the          personal identity, Visa, Admission Permit, and Visit Permit;
   
       c. 4 (four) color photographs, size 2 x 3 cm.;
   
       d. Curriculum Vitae/Resume which includes information about family, employment background, and          educational background of the foreign national concerned;
   
       e. Letters to support his/her request for a conversion and a recommendation from a related authorized          institution/department;
   
       f. A marriage certificate and information about the personal identity of the husband for a wife to join a         husband in possession of a Limited Stay Permit/Permanent Stay Permit or who is an Indonesian         citizen;
   
       g. A birth certificate and information about the personal identity of a parent for a child to join a parent in          possession of a Limited Stay Permit/Permanent Stay Permit or who is an Indonesian Citizen;
   
       h. Proof that the applicant is not included on the blacklist or the subject of an Immigration Action.
   
  B. Limited Stay Permits Into Permanent Stay Permits
   
  1. Conversion Provisions :
   
       a. Limited Stay Permits may be converted into Permanent Stay Permits with the exception of a Special          Immigration Facility Limited Stay Permit.
   
       b. The status conversion of a Limited Stay Permit into a Permanent Stay Permit may be granted to a          foreign national who can be included in the following categories:
   
           1. a capital investor who has invested his/her capital in Indonesia;
           2. a rare expatriate expert in the field of science and technology;
           3. an expatriate expert in the position of top manager of an effective and efficient capital enterprise;
           4. a foreign church person;
           5. a foreign wife, to join her husband who is an Indonesian citizen or foreign national in possession of              a Permanent Stay Permit, and has accompanied him for a long time in Indonesia;
           6. the foreign child(ren), under 18 (eighteen) years of age and single, to join parent who is an              Indonesian citizen or foreign national in possession of a Permanent Stay Permit, and has              accompanied parent for a long time in Indonesia;
           7. a foreign national in the framework of repatriation to regain his/her Indonesian citizenship;
           8. a foreign national who is beneficial to national development or other matters related to humanitarian              considerations.
   
       c. An application in triplicate for a status conversion shall be submitted to the Head of the Local          Immigration Office whose jurisdiction covers the area of residence of the foreign national concerned.
   
 

2. Requirements :

   
       a. An application letter from the foreign national concerned and sponsor containing information          concerning the purpose of the request for the conversion and a guarantee from the sponsor for the          foreign national concerned during his/her stay in Indonesia until his/her exit from Indonesia;
   
       b. Original and photocopies of a valid national passport which includes personal data, the visa, and a          Limited Stay Permit Card, showing that the foreign national has been residing in Indonesia for 5 (five)          years continuously using a Limited Stay Permit and has never left Indonesia without a Re-entry Permit          nor been overseas exceeding time limit granted;
   
       c. A Curriculum Vitae/Resume which contains information about family, educational background, and          employment background of the foreign national;
   
       d. Proof to support the information about personal data and a recommendation from a related authorized          institution;
   
       e. A marriage certificate and information concerning the identity of the husband for a wife to join a          husband who is a citizen of Indonesia or a foreign national in possession of a Permanent Stay Permit;
   
       f. A birth certificate and information concerning the identity of the parent for a child(ren) to join parent         who is a citizen of Indonesia or a foreign national in possession of a Permanent Stay Permit;
   
       g. The applicant must not be included on the blacklist or subject to an Immigration Action.
   

   
 

3.5 Change of Sponsor and Occupation

   
 

A. Change of Sponsor

   
 

I. Provision :

   
       1. A change of sponsor is a change of agency or guarantor responsible for the stay and activities of a         foreign national who is in possession of a Limited Stay Permit or a Permanent Stay Permit.
   
       2. A change of sponsor is allowed in the following cases:
           a. between firms, companies, enterprises, or private or government organizations / agencies /              enterprises from the same group and / or owner;
           b. between firms, companies, enterprises, or private or government organizations / agencies /              enterprises which have cooperative commitments based on interrelated types of products;
           c. between firms, companies, enterprises, or private or government organizations / agencies /              enterprises which have activities related to the carrying out of government projects, based on a              recommendation from a elated authority/institution/ department.
   
      3. The finalization of a change of sponsor shall be executed by the Head of the Local Immigration Office          upon approval from the Director General of Immigration through the Head of the Regional Office of          the Department of Justice or a designated official.
     
       4. An application for a change of sponsor shall be submitted by a foreign national and/or the new          sponsor to the Head of the Local Immigration Office whose jurisdiction covers the area of residence          of the foreign national concerned.
   
 

II. Requirements :

   
       1. A letter of application and guarantee from the new sponsor;
   
       2. A valid passport or travel document of the foreign national concerned;
   
       3. An Alien Registration Book and Stay Permit Card of the foreign national;
   
       4. A certificate from the former sponsor stating that there is no objection to the foreign national's          changing sponsor to be employed by a new sponsor;
   
       5. The applicant must not be included on the blacklist;
   
       6. A change of sponsor recommendation from related authorized institution/department;
   
       7. A Plan to Utilize Foreign Manpower document (RPTKA);
   
       8. A certificate of the Establishment of the Business of the former sponsor and the new sponsor.
   
 

III. Process :

   
       1. An application for a change of sponsor shall be examined by the Head of the Local Immigration Office          and sent to the Director General of Immigration through the Head of the Regional Office of the          Department of Justice or a designated official along with any recommendations, suggestions, or other          ideas.
   
       2. The finalization of the change of sponsor shall be executed by the Head of the Local Immigration          Office, upon approval from the Director General of Immigration, as follows:
   
           a. the Stay Permit shall be cancelled and a new one issued;
           b. the new Stay Permit shall be officially stamped, along with alteration notes, the number and date of              approval of the decision of the Director General of Immigration, in the passport or travel document              and Alien Registration Book.
   
       3. If the application for a change of sponsor is rejected, the Head of the Local Immigration Office shall:
   
           a. inform the foreign national concerned and/or his/her sponsor concerning the rejection of the              application and the reasons for said rejection;
           b. cancel the Immigration Stay Permit by revoking the Immigration Stay Permit Card and Alien              Registration Book of the foreign national concerned;
           c. order the foreign national to leave Indonesia, entering in the passport or travel document an official              stamp, notes about the reason for revocation, and the date of the time limit to leave Indonesia.
   
  B. Change of Occupation
   
  I. Provisions
   
       1. A change of occupation is a change of type of occupation or profession or status of employment by a          foreign national in possession of a Limited Stay Permit or a Permanent Stay Permit within the same          organization.
   
       2. The finalization of a change of occupation shall be executed by the Head of the Local Immigration          Office upon written approval from the Director General of Immigration through the Head of the          Regional office of the Department of Justice or a designated official.
   
       3. An application for a change of occupation shall be submitted by the foreign national concerned or          his/her sponsor to the Head of the Local Immigration Office whose jurisdiction covers the area of          residence of said foreign national.
   
  II. Requirements :
   
       1. An application letter and sponsor guarantee;
   
       2. A valid national passport or travel document of the foreign national concerned;
   
       3. An Alien Registration Book and Stay Permit Card;
   
       4. The applicant must not be included on the blacklist;
   
       5. A recommendation for the change of occupation from a related authorized institution/department;
   
       6. A Plan to Utilize Foreign Manpower document (RPTKA).
   
  III. Process :
   
       1. An application for a change of occupation shall be examined by the Head of the Local Immigration          Office and sent to the Director General of Immigration through the Head of the Regional Office of the          Department of Justice or a designated official.
   
       2. The finalization of the change of occupation shall be executed as follows by the Head of the Local          Immigration Office upon approval by the Director General of Immigration
   
           a. cancel the Immigration Stay Permit and issue a new one;
           b. enter an official stamp, alteration notes, and the number and date of approval of the Director              General of Immigration in the passport or travel document and the Alien Registration Book.
   
       3. If the application for change of occupation is rejected, the Head of the Local Immigration Office shall:
   
           a. inform the foreign national concerned and or his/her sponsor concerning the application rejection              and the reason for the rejection;
           b. cancel the Stay Permit by revoking the Stay Permit Card and the Alien Registratio Book;
           c. order the foreign national concerned to leave Indonesia, entering in the passport or travel              document an official stamp, notes concerning the reason for the rejection, and the date of the time              limit to leave Indonesia.
   

   
 

3.6 Menikah di Thailand

   
  Syarat yang diperlukan adalah:
   
 

      KTP asli beserta fotocopynya

        Paspor asli beserta fotocopynya
        Surat Keterangan Status Nikah dari Kelurahan di Indonesia
        Fotokopi identitas calon suami/isteri
        Akta Cerai asli dan fotocopnya (bagi duda/janda cerai)
        Akta Kematian mantan suami/isteri (bagi duda/janda)
        Surat Izin Orang Tua yang disahkan oleh Kelurahan (bagi yang berumur kurang dari 20 tahun)
        Waktu Permohonan Surat pukul 09.00 – 11.45 setiap hari kerja. Surat tersebut dapat diambil pada             hari kerja berikutnya pukul 14.00 – 15.30
        Yang bersangkutan harus datang ke KBRI (tidak dapat diwakilkan)
   
  Elucidation Letter for marriage registration in Thailand:
   
  Requirements:
   
        Original and copy of ID Card (KTP)
        Original and copy of passport
        Elucidation of marital status from District office in Indonesia (Surat Keterangan Belum Menikah dari            Kelurahan, kecamatan dst dan diketahui orang tua)
        Copy of your bride/groom ID Card
        Original and copy of Divorce Certificate (for divorce status)
        Original and copy of Death Certificate of ex husband/wife (for widow/widower)
        Parent permission letter legalized by District Office (for the one who are under 20 years old)
        Application must be made in person
        The above documents need not to be translated in English
        Application time is at 09.00-11.45 of every working days. The document will be returned on the next            working days at 14.00-15.30
   

   
 

3.7 Pembuatan SIM Thailand

   
 

Syarat yang diperlukan adalah:

   
        Paspor asli dan foto kopinya
        Mengisi formulir S
        Memiliki Visa Non-Immigrant (visa turis tidak dapat membuat SIM)
        SIM Indonesia asli (syarat tambahan)
   

   
 

3.8 Pindahan ke Indonesia

   
 

Syarat yang diperlukan adalah:

   
        Paspor asli dan foto kopinya;
        Surat Keterangan dari tempat kerja yang menerangkan: tanggal mulai bekerja, tanggal selesai masa            kerja, jabatan;
        Mengisi formulir S
        Telah bekerja dan tinggal di Thailand paling sedikit 1 tahun;
        Packing List/List of Personal Effects asli dan foto kopi;
   

   
  3.9 Pengurusan Paspor Bagi Anak Perkawinan Campur
   
  Syarat yang diperlukan:
   
        Akta Nikah
             - Menikah di Indonesia:
               Bawa akta nikah asli dan potokopi 2 rangkap.
   
             - Menikah di Thailand:
               Akta Nikah tersebut harus diterjemahkan ke dalam bahasa Inggris dan dilegalisir oleh Kementerian              Luar Negeri Thailand (Dept. of Consular Affairs).
   
             - Menikah di luar Indonesia/Thailand:
               Akta Nikah tersebut harus diterjemahkan ke dalam bahasa Inggris dan dilegalisir oleh Kedutaan              negara asing yang mengeluarkan akta tersebut.
   
        Akta Lahir Anak
            - Lahir di Indonesia:
              Bawa akta lahir asli dan potokopi 2 rangkap
   
            - Lahir di Thailand:
              Akta Lahir tersebut harus diterjemahkan ke dalam bahasa Inggris dan dilegalisir oleh Kementerian             Luar Negeri Thailand (Dept. of Consular Affairs)
   
            - Lahir di luar Indonesia/Thailand:
              Akta Lahir tersebut harus diterjemahkan ke dalam bahasa Inggris dan dilegalisir oleh Kedutaan             negara asing yang mengeluarkan akta tersebut.
   
        Potocopi paspor Suami yang telah dilegalisir oleh Kedutaan Negara suami
   
        Paspor Ibu (WNI) asli dan fotokopi 2 rangkap
   

   
 

3.10 Permohonan Surat Keterangan Lahir

   
 

Syarat yang diperlukan:

   
        Akta Lahir Thailand yang telah diterjemahkan ke dalam bahasa Inggris dan telah dilegalisir oleh            Kementerian Luar Negeri Thailand (Department of Consular Affairs);
        Foto kopi paspor kedua orang tua;
        Foto kopi akta nikah (apabila tidak menikah di Indonesia, foto kopi akta nikah harus diterjemahkan            ke dalam bahasa Inggris dan mendapatkan legalisasi dari Kementerian Luar Negeri atau perwakilan            negara yang mengeluarkan akta nikah tersebut);
        Pas foto berwarna anak ukuran 4x6 sebanyak 2 (dua) lembar dengan latar belakang warna merah;
